In USA, the company, who sponsored H/L visa and brought someone from home country is responsible for ticket to home country.
I wish this does not happen, but in all others case (H1B transfered, OPT -> H1B, EAD, etc.), one has to bear own expenses. Many H1B, students and EB guys have been compelled to go back to home country during last downturn - mostly they has gone back on own expense.
If one takes help of home country embassy (costs home country), that person may be barred from leaving home country in future.
I think Spain case is not applicable here in US.

I think for EB2 it is appx 113K USD when GC is approved.It depends on your state wages...

pledging and donating regularly is a novel concept for immigrant population, there has been some market research as well done on this when I was back in business school - feels a long time back!
Good to see folks coming out and signing up for recurring donations - every small amount counts as long as it is recurring.
For folks who want to celebrate the procurement of Greencard, it is fine as well but let's try focusing on the present than on future or past (courtesy: dialog from Rang De Basanti)...not trying to demean but trying to emphasize on the importance of present day!

The USCIS website says one need to file 6 months in advance for EAD. It may come out to be true now based on the flood of applications received after July 1st this year. I filed for EAD extentions 3 times in last three years and last 2 times I got in less than a month, this year it took close to 3 months. So always apply 6 months in advance as advised in website

Anyone got a generic response to an I-485 Service Request that "your case is awaiting standard security checks required for everyone who applies for this immigration benefit"?

How about thread "lighten up"??? Although its not relevant to Immigration, it sure is a good thread that helps everyone to lower their blood pressure after reading visa bulletins and other Immigration hassles.
There are not many insignificant threads that encompasses Immig threads, moreover if you notice they show up when not much is happ on a particular day

I seriously doubt if anybody ever reads them, as is evident from the absence of any other user's reply to these threads. Why don't we just remove them, or block them from showing up on the main page. EAD/AP is personal choice. Employer can only govern what he has under his control - which is LC and I-140. He cannot chose to not allow EAD or AP, and you are not obliged to inform him. Good employers sponsor everything and the rest dont. But legally (i am not a lawyer though), they cannot do anything with you if you apply for EAD and keep it as a backup. Yes, if you chose to use your EAD to do extra work in addition to your employer's it may come against company policy. But if you intend to just keep it as a backup, there is nothing wrong..
Go to USCIS efile website and file it on your own (EAD and AP).

When my AP came up for renewal my attorney asked to get new set of photos.
In addition my cousin's EAD application got RFE'ed to get new set of photos even though the photos were recent. The reason given was that they had used same photos to renew their visa few months back (less than 6 months).
Is USCIS coming up some new rule about photos being 'unused' ?? The guidelines say that photos should be recent (taken in last 6 months). However nowhere I do I see that the photos should be 'unused' previously ?
Anyone else had same experience ?

I am on h1b visa and want to buy a property in india. My parents in india will be the POA. Can someone suggest which is better- taking a personal loan from a bank in India or here?Also, if someone has done the same, can u provide the details about how much loan one can get, any good bank to get it and the paperwork etc. thanks a lot.

The desperation of your post suggests that you don't need direction, you need therapy. We just need someone to give us some assurance that we will all be fine and live to see the light of the day on Tuesday even if DoS sends out a revised Visa Bulletin. At this time, I too need similar assurance from someone. Can anybody help?

This may be something that's already been addressed somewhere so my apologies in advance if that's the case

irrational - Sorry to say this is little bit unlucky case. This happened to me also. My case got transferred to VSC from TSC in July 2009 and from then it is sitting there with no progress. Taken info pass but no use. (Yet to think about the next steps!).
I applied for EAD and AP in Aug last week and got the approved copies in Sep second week. I sent the application to TSC.
mmanurker - Can you please tell me how long your application was present in VSC? Also did you do anything to move it back to TSC or NSC.

I am on H1B in USA and now I am planning to set up a company in India. Will I be violating any laws by doing this.
Can I operate the company from USA and still get payed in India. My clients will be paying my company in India.
Will I have to pay taxes in USA.

If you are doing the work from USA, then you have to get paid in USA and pay US taxes.
If you are getting the work done from India, only then your clients can pay your company in India.

It has not passed April 04 since Sept 05 (when it was current) and during July Fiasco.
I was just a couple of months away when PD reached APR 04, it remained there for sometime, got retrogressed and now it is again back to square one at the same date. Wonder what the bottleneck on APR 04 is?.
